MHA Proposes New Chapter K under Article 371 for Ladakh
The Ministry of Home Affairs (MHA) has proposed a new constitutional provision, Article 371(K), aimed at providing special safeguards and a customised governance framework for Ladakh. The proposal emerged during recent discussions between the Centre and representatives of Ladakh, marking a significant development in the ongoing dialogue over constitutional and administrative protections for the Union Territory.
The proposed framework is intended to address key concerns related to land protection, employment opportunities, cultural preservation and local participation in governance. While Ladakh representatives have been seeking safeguards under the Sixth Schedule, the proposed Article 371(K) could establish a Ladakh-specific model of self-governance tailored to the region’s demographic, ecological and administrative requirements.
Discussions have also focused on strengthening the role of an elected Union Territory-level body, with potential legislative powers over areas including land, culture, language, forests, environment and natural resources. However, several details regarding the scope of powers and institutional responsibilities remain subject to further deliberation.
From a governance perspective, the proposal reflects the Centre’s efforts to balance constitutional protection, democratic representation and regional development while safeguarding Ladakh’s distinctive cultural and ecological identity. Further consultations are expected to determine the final structure and powers of the proposed framework.
